Important stuff, please read!

These terms and conditions apply to both Lancs Local Business Partners and Lancs Local Members. Please read the following carefully as joining Lancs Local as a business or member assumes agreement with all terms and conditions. By ordering a membership card or becoming a business partner, you agree to be bound by these terms and conditions.
By becoming a member of Lancs Local and applying for a membership card you confirm that you have read and agree to all of our terms and conditions and that you consent to us processing your data in accordance with our privacy policy.
  1. By applying for a Lancs Local Card, you warrant that you are legally capable of entering into binding contracts and you are at least 18 years old.
  2. We reserve the right to amend these terms and conditions at any time by giving you notice by posting the amended terms and conditions on our site.
  3. When you sign up to Lancs Local as a member you will be directed to the digital membership card in order to complete your membership. Once completed your digital membership will be available within 48 (usually immediately) hours and can be used across Lancs Local Businesses immediately.
  4. When you apply for your digital membership card you will be required to follow instructions regarding the set up and application of the digital membership and will be required to have the relevant app downloaded on your phone.
  5. Lancs Local membership is an ongoing subscription service and will automatically renew every 12 months at a cost of £24. We reserve the right to amend the subscription amount at any time.
  6. Your Lancs Local Card will be valid until the expiry date shown on your digital card. Assuming your subscription renews, the expiry date on your digital card will update automatically.
  7. You can cancel at any time, your membership will continue to renew at the end of each subsequent term until it is cancelled in accordance with the Terms and Conditions.
  8. By registering to participate in the Lancs Local Card Membership you will be asked to provide certain personal information, including your name, mobile phone number, email address and date of birth. We are committed to maintaining the security of your personal information in accordance with the requirements of the Data Protection Act 1998 (and any other applicable data protection laws) and will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction. The Privacy Policy will apply whenever you provide us with personal information and is incorporated by reference into the Terms. Except as required by law, or in accordance with the Terms and the Privacy Policy, your personal information will not be passed to any other person without your permission.
  9. You have the right to cancel your Lancs Local Card at any time however a refund will not be issued. Discounts and offers will be applicable until the end date of the paid subscription.
  10. Your Lancs Local Card can and may be used to track your purchases for our own research to develop the service.
  11. Your Lancs Local Card is issued by and remains the property of Lancs Local; Lancs Local reserves the right to withdraw the card at any time.
  12. Lancs Local reserves the right to alter or amend the conditions of operation of the scheme at any time without notice.
  13. Lancs Local Card is to be used by the purchaser only. If you are buying as a gift, the name of the card holder must be specified at time of purchase.
  14. Your Lancs Local card is strictly non-transferable and so cannot be used by either friends, family members or other third parties.
  15. To qualify for the discounts stated on the website, the card must be presented to the relevant vendor. This can be in person or online, via screenshot. If a discount code is required, enter the code and immediately send a screenshot of your Card to the vendor to verify your membership.
  16. Please check the terms and conditions of the particular offer and vendor you are interested in before making a purchase.
  17. Where a vendor requires you to pre-book (e.g classes, activities, days out) you should state at the time of booking that you intend to use your Lancs Local Card
  18. In all other circumstances, you must inform the vendor that you intend to use your Lancs Local Card prior to purchase. Once a product or service has been paid for, the discount or offer cannot be applied retrospectively. If a discount code is required, enter this and then present your card online or via text.
  19. Lancs Local reserves the right to take any appropriate action deemed necessary where it is found the cardholder has used the card in breach of these terms and conditions.
  20. Lancs Local are not responsible for any complaints or issues with the individual businesses offering discounts, these must be bought up with the businesses themselves. If a vendor refuses to provide the discount for any reason Lancs Local will not be held liable and will not issue any refunds.
  21. Refunds will not be issued if you have problems with the service you receive from our business partners, this must be put in writing to the business concerned who will deal with it according to their own policies.
  22. If you have any issues or complaints regarding Lancs Local business partners you agree to inform Lancs Local.
  23. Discounts will not be redeemed for cash.
  24. Lancs Local will use reasonable endeavour to notify participants one month before expiry date although we have no obligation to do so.
  25. Lancs Local may, at our sole discretion, refuse to issue a Card and may withdraw a Card from a participant at any time.
  26. Lancs Local will not be responsible for any indirect losses, consequential, exemplary, special or punitive damages, lost opportunities, loss of profits, anticipated profits, actual or anticipated savings.
  27. Lancs Local does not limit its liability at law for fraudulent misrepresentation or for death or personal injury caused by negligence or any other type of liability which cannot by law be excluded or limited.
  28. The Terms shall be governed and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England.
  29. After applying for a Lancs Local Card you will receive an e-mail acknowledging that we have received your application. Please note that this does not mean that your application has been accepted. Your application can be assumed to have been successful on activation of your digital membership card.
  30. All orders are subject to acceptance by us and we may retract acceptance at any point.
  31. Lancs Local cards are valid up to and including the expiry date on the digital card. The expiry date of each card will vary and will always be checked.
  32. Subscriptions will renew automatically every 12 months unless cancelled a minimum of 10 days before the current expiry date.
  33. To cancel your membership, please email hello@lancslocal.co.uk. Upon cancellation you will receive a confirmation email; it is recommended that this is kept for your own personal records.
  34. Free or discounted memberships: If you sign up for a free or discounted membership and you no longer wish to continue to be a member at the end of the term, you must cancel your membership at least 10 days before the expiry of the free term. Renewals are automatic and if you do not cancel your membership you will be automatically charged for the following 12 month subscription at the current full price..
  35. The price of membership of the club will be as quoted on our website, except in cases of obvious error.
  36. Prices are liable to change at any time.
  37. Payment must be by credit or debit card via the digital membership app.
  38. Please check the terms and conditions and privacy policy of the digital membership app as they may differ to those of Lancs Local. You accept all responsibility for use of your details as gathered by third party apps.
  39. Where a physical card has been purchased. There is an admin charge of £3 for a replacement card should you require one. We reserve the right to refuse to replace a lost card.
  40. On presentation of your membership card to Lancs Local business partners, they will apply the discount to your bill/receipt/invoice. Please check the digital membership card and individual business partners for terms and conditions applied to each individual offer and verify these with the retailer.
  41. Participating businesses may exclude certain days, particular products or services or members of staff. Please check any exclusions before purchase.
  42. Offers advertised on our site are only available to members who present a valid membership card to Lancs Local business partners. Such offers are not available in conjunction with any other offers that participating business may be running. All offers are subject to availability and all partners reserve the right to refuse the sale of a product or service.
  43. All offers on our website are assumed by us to be correct. It is the Lancs Local members’ responsibility to double check that the offer is still available at the time of purchase. We will use reasonable endeavours to update our site to show the particulars of participating business and the terms of their availability for participation in the club. Participating businesses may, however, be entitled to withdraw from the club or to change the terms and conditions of their availability after you have become a member and we shall have no liability for any such withdrawals or changes in terms and conditions or availability.
  44. Members will have the benefit of any additional businesses which join the club after the date your membership commenced.
  45. All partners reserve the right to refuse the sale of a product or a service. All offers are subject to availability.
  46. If we fail to comply with these terms and conditions, we shall only be liable for the membership fee.
  47. Included in your Lancs Local Membership a World Privilege Plus (WPP) package with extra discounts and offers. This is offered under a white label and is referred to as Lancs Local + Any discounts under this platform are at the discretion of WPP, who have their own terms and conditions and privacy policy. Lancs Local can not be held liable for any issues whatsoever between Lancs Local Members and Lancs Local +/WPP. If you do have any issues, these must be taken up with WPP directly.
  48. We will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories:
    • loss of income or revenue;
    • loss of business;
    • loss of profits; or
    • loss of anticipated savings.
  49. Nothing in this agreement excludes or limits our liability for:
    • death or personal injury caused by our negligence;
    • fraud or fraudulent misrepresentation;
    • any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or
    • any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.
 Where you purchase an item from any participating business, any losses or liability arising out of, or in connection with, such item shall be the relevant participating businesses liability. We accept no liability for any bad experiences or bad items purchased at any of the participating businesses. We will not become involved in any dispute between you and any business.
  1. We do not give any warranty for any goods or services accessed through, or displayed on, our site.
  2. Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
  3. Failure by us to enforce any of these terms and conditions will not prevent us from subsequently relying on or enforcing them.
  4. If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
  5. A person who is not party to these terms and conditions shall not have any rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999.
  6. These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions. We each acknowledge that, in entering into these terms and conditions, neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them. Nothing in this clause limits or excludes any liability for fraud.
  7. This agreement shall be interpreted in accordance with the English law and subject to thenon-exclusive jurisdiction of the English Courts.
 
Business Partners
  1. Businesses may exchange products or services for a similar reward at any time as long as they have confirmed this with Lancs Local and their page on our website has been updated to reflect the change of offer.
  2. Lancs Local are not responsible for any complaints or issues between members/customers and individual businesses offering discounts. Lancs Local will not be involved in any altercations; any issues must be dealt with directly between the business and the customer.
  3. By listing your business on the Lancs Local website and digital membership card, you agree to give the discount specified on your page to Lancs Local Card holders. If you wish to change the discount or offer you must email us at hello@lancslocal.co.uk and allow 7 days between our acknowledgement and agreement of the change and the change of details on the website. We also ask that you give 7 days grace period after changing any offer in order for customers to take advantage of any offers they may have seen.
  4. Should you wish to leave the scheme we require written notice of 30 days. Discounts and offers must be honoured until the end of this notice period.
  5. Lancs Local reserves the right to remove any business at any time without warning.
  6. We do not give any warranty for any goods or services accessed through, or displayed on, our site.
  7. All businesses that partner with Lancs Local give permission for us to advertise the named business and the discount provided. Advertisement methods to include but not be limited to website and social media, printed and visual marketing campaigns, event campaigns and word of mouth.
  8. All businesses that decide to partner with Lancs Local will be added to our mailing list. They can opt out of these emails via email to hello@lancslocal.co.uk.
  9. The above terms and conditions are valid from 22nd July 2020 until further notice.
